Can an employer use image and sound monitoring in the workplace?

ANSWER

The issue of monitoring in the workplace is currently regulated by Article 22² of the Labour Code. That provision permits only visual monitoring in the workplace. At present, the law does not allow sound recording. An employer using such a form of monitoring therefore breaches both labour law and personal data protection law as a data controller. The provision cited regulates the rules for using visual monitoring in the workplace, and every employer that uses monitoring is obliged to comply with those rules. If it does not, employees may report such a breach to the Labour Inspectorate and the President of the Personal Data Protection Office.
