What are the conditions for giving consent?

ANSWER

Consent should above all be freely given, specific, informed, and unambiguous, and therefore should have the characteristics of a statement of will required by the GDPR (as stipulated in Article 174 of the Telecommunications Act). The data subject must have an easy possibility to refuse consent without incurring any negative consequences (e.g. inaccessibility of website content).

At the same time, the required information must be made available to the data subject, including information about the purpose of processing, who will process the data, for how long, and whether the data will be transferred to other entities or to third countries. Giving consent should not be confusing or burdensome for the user, meaning that even if the user has made a decision regarding consent or refusal for each individual cookie, purpose, or controller, they should also have an easy option to refuse all cookies/processing purposes/controllers at once. The consent requirements are described in more detail in EDPB Guidelines 05/2020.
